we don't know the sesk conditions of their house arrest, for example whether or not they can use cell phones or computerers even go to school purr but we know they all must wear ankle brace lets. the three teenage boys accused of sexually assaulting audrie pots all attended sar toy gla high school at the time of the attack. they were released from juvenile hall under house arrest. the device on their aings ankles are less than -- if they violate it, then the conditions of their release could be violated and they could be put back into custody until they have to go to court. >> the attorney representing audrie's family issued a statement today saying the family remains hopeful the young men will be prosecuted as adults. we otherwise are concentrating our energy on implementing new

legislation. the family has contacted jim bale about proposed new legislation. he says one of his top priorities is to make changes to the system doesn't treat sexual assault different when the victim is unconscious. the d.a.'s office is still trying to determine if these teens should be charged as adults in this case. marry an favro. >> apple investors got some good news this afternoon. the cupertino based company released its earnings report and it was better than expected. it sold more than 37 million iphones over the last three months i long with 19 million i pads. the company says it will increase the cash dividend it pays to shareholders. it could soon cost you more money to shop online.

years old. >> the burlingame school district broke ground on a school. some neighbors say the location is all wrong. hoover was built in the '60s and turned into a temple in '70s. but om neighbors here sum met drive are going to court to fight the plan. they say the narrow streets and a like of sidewalks won't accommodate the crowds that come with the school. >> i don't think it's a safe place to have a school. you can see by the lack of sidewalks it's a concern. we live in hills borrow. our children do not benefit from this school at all yet. we're going to be impacted with traffic and the big concern is the welfare of the children. >> the district plans to remodel the school, widen part of the street and build a drop off zone for students. it's expected to open in the 2014, to 15 school year. >> green is universal all this

nine len then -- >> so. >> reporter: so kim ba started urban relief and 15 years later, there are now 15,000 more trees in the city of oakland than before, trees shagd the sun, housing the birds, cleaning the air and more importantly for kim ba, providing work and volunteer opportunities for the young men of oakland. >> after they plant those four trees have them come over here. >> but to say kim ba is not down yet is an understatement. she has her eyes set on a million trees planted in oakland, not an easy task for sure but one kim ba says simply must be done. >> just see how just planting those trees gives that immediate impact. it makes you feel really good. >> for the work over the years kim ba has received dozens of awards, most recently the barefoot wine, they have their souls of the year and he's one of the souls of the year.

pet has been come tam nated. >> reporter: it's not uncommon for you dog or cat to have an upset stomach. sometimes they get too treats. but it's when those tummy troubles are prolong and they're intense. you need to call the vet especially if the food they get is included in the recall. the dog food was pulled off the store shelves because of the recall affecting the product brand. the impact is great. this is a major manufacturer for us and the time it take to make sure that the family pets are healthy and safe, wit's worth the effort of course. >> reporter: the voluntary recall covers several dry food brands, health wise, no va for dogs and accounts with a use by date of march 2014. the veterinarian says hae has no

"nightly news" begins now. from nbc news world headquarters in new york, this is "nbc nightly news" with brian williams. good evening. despite his wounds, the surviving bombing suspect in boston is now communicating with investigators, and apparently he's telling them he and his older brother acted alone with no outside help. in the grim business of terrorism, that would make these two what are called self-radicalized jihadists, a polite term in this case for the surviving accused cold-blooded murderer who thought nothing of depositing bombs meant to kill and injure innocent citizens including children. we learned other new details about this case today. pete williams continues to lead our coverage of the investigation. he's in our washington newsroom tonight. pete, good evening. >> reporter: brian, good evening.

investigators say they think they know the answer to who did the bombing, just the two brothers, and the surviving suspect has provided an answer as to why. now the fbi is trying to determine whether there's evidence to back up his story. as dzhokhar tsarnaev lies under guard in a boston hospital now upgraded to fair condition, federal officials say he's told interrogators that he and his older brother came up with the marathon bomb plot entirely on their own because they believe the u.s. wars in iraq and afghanistan were an attack on islam. officials say he claims the instructions for making a bomb came from al qaeda's online magazine "inspire" which contained a formula similar to the one the fbi says was used to make the bombs in boston. an employee at a fireworks company says records show that tamerlan tsarnaev bought two dozen large fireworks at a store in new hampshire in february. >> it's a little disturbing, a little unsettling that i had an in
